1. Introduction

Welcome to Top Tier Chauffeur Services.  These Terms and Conditions govern your use of our services, including bookings, transactions, and any interactions with our website or mobile applications. By using our services, you agree to comply with and be bound by these Terms.

2. Service Agreement

Booking: To reserve our limousine services, you must provide accurate information, including your name, contact details, and payment information. We reserve the right to refuse service if the provided information is incomplete or inaccurate.

Payment: Payment for services must be made in accordance with our payment terms, which may include deposits or full pre-payment, depending on the nature of the reservation. Payment can be made via accepted methods including credit/debit cards or other approved payment methods.

Parental Consent Requirement: All minors under the age of 18 boarding our limousine services without the presence of a parent for any limousine reservation must submit a completed and signed parental consent form for liability and safety reasons. Minors that have not completed the parental consent form may not board any limousines provided by the company.

3. Cancellation and Refunds

Cancellation Policy: Please refer to our Cancellation Policy for details on how to cancel a reservation and any applicable cancellation fees

.Refunds: Refunds will be processed in accordance with our Cancellation Policy. Any disputes regarding refunds should be directed to our customer service team.

4. Responsibilities of the Customer

Accuracy: You are responsible for providing accurate information for the booking, including pick-up and drop-off locations, and ensuring that all members of your party are aware of and comply with our policies.

Behavior: You and your guests are expected to behave in a respectful and lawful manner while using our services. Any damage to the vehicle or inappropriate behavior may result in additional charges or termination of the service.

Smoking/Vaping/Illegal Substances ARE PROHIBITED: Smoking and vaping of any kind, including but not limited to marijuana use, cigarettes, cigars, e-cigarettes, and vape pens, are strictly prohibited in any vehicle operated by the Company and its Affiliates or Affiliate Companies. The use, possession, or distribution of any illegal substances, including but not limited to marijuana, narcotics, and controlled substances, is strictly prohibited in any vehicle operated by the company and their affiliates. The Company reserves the right to refuse service to any client or passenger who is found to be in violation of this policy. This includes situations where smoking, vaping, or illegal substance use is detected or suspected. The Company reserves the right to terminate service immediately if any client or passenger is found to be engaging in prohibited activities. In such cases, the Company will not be liable for any refund or reimbursement for unused service time.
Damage Charges: Clients will be held financially responsible for any damage caused to the vehicle including causes as a result of smoking, vaping, or the use of illegal substances. This includes, but is not limited to, damage to upholstery, carpeting, and other interior components. Costs for repairs or replacements due to such damage will be assessed and billed to the client.

Agreement to Terms: By paying for the reservation and utilizing the services of the Company, clients acknowledge and agree to adhere to all Terms and Conditions listed here and accept responsibility for any associated charges incurred.

5. Our Responsibilities

Service Delivery: We will make reasonable efforts to provide the limousine service as booked. However, we are not liable for delays or issues caused by factors outside our control, such as traffic conditions or weather.

Vehicle Condition: We will ensure that our vehicles are in good working condition and comply with all relevant safety and legal requirements. If our vehicles become unoperable and cannot perform the booked service, the Company will make reasonable efforts to provide another similar vehicle or an upgrade if available. If we are not able to provide another vehicle due to availability, the Company will provide a full refund or a credit for the service.

6. Limitation of Liability

No Liability for Indirect Damages: We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits or personal injuries, arising from the use of our services.

Maximum Liability: Our liability for any direct damages or claims arising from our services is limited to the amount paid for the specific reservation in question.

7. Force Majeure

We are not liable for failure to perform our obligations under these Terms if such failure is caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, road conditions, or other force majeure events.

8. Privacy Policy

Your use of our services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

9. Governing Law

These Terms and any disputes arising from your use of our services will be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

10. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Houston, Texas.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes are made constitutes acceptance of the revised Terms.
